The Biden administration is preparing an executive order to restrict U.S. investment in China's advanced technology companies to protect national security. Identifying AI that could pose a threat is challenging and the order may include bans or disclosure requirements for AI investments. 

The US administration aims to balance security concerns while maintaining trade flows, but enforcing such policies is complex due to AI's dual-use nature. U.S. investors have already been involved in numerous transactions with Chinese AI companies making limitations on investment more difficult as some companies already rely on these financial partnerships. Export bans on advanced semiconductors are being used to limit AI development. Knowledge transfer to Chinese startups is a concern.

Chinese tech giants like ByteDance, Tencent, Baidu, and Alibaba have a strong demand for Nvidia's HPC products. ByteDance alone has ordered around $1 billion worth of Nvidia GPUs in 2023. Despite export restrictions, Chinese companies are investing heavily in HPC hardware to prevent the West from dominating AI. The volume of orders from Chinese tech giants is overwhelming China's distributor chain, leading to direct negotiations with Nvidia. The significance of ByteDance's orders is notable, considering Nvidia's H800 cards only began production in March.
